Provisional measures and possible sanctions

The Commission's investigation will delve into two main issues . On the one hand, TikTok's compliance with the DSA's obligation to prepare and submit a risk assessment report before deploying features that pose a critical impact (in this case, the rewards program and its effect on mental health, especially of minors). And, on the other, the measures taken by the platform to mitigate these risks. " If proven, these breaches would constitute infringements of Articles 34 and 35 of the Digital Services Act ."
Furthermore, if TikTok does not respond in time to the new request for information, the Commission could “ impose fines of up to 1% of the provider’s total annual revenue or worldwide turnover and periodic bolivia number data penalties of up to 5% of the provider’s average daily revenue or worldwide annual turnover .”
The Commission also announced its intention to impose provisional measures that include the suspension of the rewards program in the EU . “ Given TikTok’s failure to submit the risk assessment that should have been carried out prior to the launch of TikTok Lite, the Commission suspects a prima facie infringement of the Digital Services Act and considers that there are risks of serious harm to the mental health of users . ”
The Commission has therefore also informed TikTok of its intention to impose provisional measures consisting of the suspension of the TikTok Lite rewards programme in the EU pending its security assessment. This could be renewed if necessary and proportionate. Before formally adopting the suspension, TikTok was granted until 24 April to present arguments in its defence which the Commission will carefully assess .
